General terms and conditions for events at the 58th Choriner Musiksommer 2021

1. Scope of application

1.1 General

These general terms and conditions (“GTC”) govern the legal relations between Choriner Musiksommer e.V. (“Choriner Musiksommer” or “We”) and the audience (“Attendees” or “You”) to concerts and other events (hereinafter uniformly referred to as “Concerts”) at the 58th Choriner Musiksommer 2021. The GTC are an integral part of the contract which is concluded by the purchase of a ticket. Under the terms stipulated by the GTC, purchasing a ticket can also be effected by redeeming a coupon issued under the COVID-19 Pandemic Mitigation Act (Gesetz zur Abmilderung der Folgen der COVID-19-Pandemie im Veranstaltungsvertragsrecht) for a Concert cancelled in the year 2020.

1.2 Entry into force and applicability

These GTC apply exclusively to the purchase of tickets for Concerts at the 58th Choriner Musiksommer 2021. They enter into force on 1 March 2021 and replace any previous versions. They are valid until 31 October 2021.

1.3 Use of the term “consumer”

Some provisions of the GTC are applicable to Attendees only if they are consumers within the meaning of section 13 of the German Civil Code (Bürgerliches Gesetzbuch, BGB). Attendees are consumers if their purchase of tickets is not primarily undertaken in the course of commercial or independent business activities.

3. Concert programmes

Choriner Musiksommer’s Concert programmes and starting times are published in the printed annual programme and on the internet at www.choriner-musiksommer.de (“Website”). Please note that these may be subject to changes due to artistic or organisational reasons. Any such changes will be communicated on the Website.

4. Ticket prices

Choriner Musiksommer will publish their current prices for Concert tickets (“Tickets”) in their printed annual programme and on the Website (“Published Ticket Prices”).

4.1. Ticket prices when purchasing by phone (see section 5.3.1 of the GTC) or by letter (see section 5.3.2 of the GTC)
The final ticket prices correspond with the Published Ticket Prices plus an advance booking fee per ticket. In addition, customers will be charged a flat-rate postage and handling fee (see section 5.5 of the GTC).

4.2. Ticket prices when purchasing online via the www.reservix.de ticket portal (see section 5.3.3 of the GTC)
The final ticket price when purchasing on www.reservix.de includes the normal ticket price, an advance booking fee per ticket and a service fee per purchase. Depending on the customer’s choice of particular services, such as shipping, payment or insurance options, varying additional fees may be charged. The final amount and a breakdown of its components (ticket price and fees) will be communicated to the Attendee via the electronic shopping cart created in the course of the online purchasing process. By clicking the purchasing button at the end of the process, the Attendee confirms the final ticket prices and fees thus listed.

4.2. Ticket prices when purchasing online via the https://tickets.vibus.de ticket portal (section 5.5.4 of the GTC)

The final ticket prices correspond with Choriner Musiksommer’s Published Ticket Prices plus a flat-rate postage fee. The ticket portal may charge additional shipping and advance booking fees as well as online and handling fees for the processing of orders. These will be communicated during the process of ordering.

4.2. Ticket prices when purchasing at theatres’ on-site or online box offices
The final ticket price includes the price of the ticket plus the fees charged by the respective box office. Depending on the Attendee’s choice of particular services, such as shipping, payment or insurance options, varying additional fees may be charged. The final amount and a breakdown of its components (ticket price and fees) will be communicated to the Attendee by the box office in the course of the purchasing process. By purchasing, the Attendee confirms the final ticket price and fees.

5. Ticket sale

Attendees can purchase tickets in advance by email, fax or letter, by phone via Choriner Musiksommer’s offices, online via www.reservix.de and https://tickets.vibus.de, or at theatre box offices. Remaining tickets will also be sold at the local box office.

5.1 Advance booking period

Advance booking starts on publication of the 58th Choriner Musiksommer’s programme on the Website. Advance booking for any particular concert ends 12 working days prior to the date of the Concert.

5.2 Limitation of ticket offers

When purchasing online via the ticket portals www.reservix.de and https://tickets.vibus.de, You may buy a maximum of ten (10) tickets per Concert.

5.3. Ticket purchasing process and payment methods

5.3.1 Purchasing via phone

Advance booking via phone is possible Monday to Friday from 9 am to 1 pm by calling +49 (0)3334 – 818472.

Payment can be made in advance by bank transfer. We will send You a binding offer according to Your booking details via email, fax or letter. The offer includes an invoice listing the number of tickets booked, the ticket prices, the postage fees, Our bank details and a statement of the payment term of fourteen (14) days. Your payment within this period indicates that You are accepting this offer and validates the contract between You and Us. If the amount of the invoice is not credited to Our bank account within the term of payment, We will reoffer the tickets for sale.

5.3.2 Purchasing by email, fax or letter

5.3.3 Online ticket purchasing via the www.reservix.de ticket portal

You can purchase tickets in advance via the www.reservix.de internet portal. To do so, you must additionally accept the terms and conditions of the operator of the portal, Reservix GmbH, Humboldtstraße 2, 79098 Freiburg (“Reservix”), as shown on their website.

You are making an offer to conclude a contract by clicking the purchasing button (“Kaufen”) in the course of placing your booking order.

The contractual language is German. The GTC can be viewed and saved at https://www.choriner-musiksommer.de/allgemeine-geschaeftsbedingungen. You are also entitled to print them. By offering tickets at the ticket portal, We do not make a binding offer to conclude a contract but invite Attendees to submit an offer of purchase. You can select tickets by moving them to the shopping cart without committing to a purchase yet. You will subsequently be asked to enter Your personal data and bank details.

By clicking the ‘Buy Now’ button (“Jetzt kaufen”), You are submitting a binding offer to conclude a contract. Purchasing is only possible if You confirm that You agree with the GTC (“Ich erkläre mich mit den AGB einverstanden”) by activating the appropriate checkbox. The word ‘AGB’ is formatted as a link which takes You to the GTC and allows you to view them before You purchase. The details of your order will also be displayed again prior to purchasing. You can change those details using the correction controls provided by the website. We will confirm Your order immediately via email (“Confirmation”). In doing so, we are accepting Your offer, and a contract between You and Us will come into effect. After processing the order and sending the Confirmation, We will store the text of the contract (the Confirmation and these GTC), but it will no longer be accessible to You online.

Unless otherwise agreed, payment of the ticket fees is due immediately upon concluding the contract. We accept advance payment via bank transfer or immediate payment via PayPal. When choosing advance payment via bank transfer, the Attendee transfers the total price of the tickets to the account of Choriner Musiksommer. Bank details will be disclosed to the Attendee on the invoice.

We reserve the right to exclude particular methods of payment or refer to other methods of payment under special circumstances. The payment methods available will be displayed to the Attendee prior to booking.

5.3.4. Online purchasing via https://tickets.vibus.de

You can purchase tickets in advance via the https://tickets.vibus.de internet portal. To do so, you must additionally accept the terms and conditions of the operator of the portal, SWH Software GmbH, Attilastr. 61-67, 12105 Berlin („SWH“), as shown on their website.

The contractual language is German. The GTC can be viewed and saved at https://www.choriner-musiksommer.de/allgemeine-geschaeftsbedingungen. You are also entitled to print them.

By offering tickets at the ticket portal, We do not make a binding offer to conclude a contract but invite Attendees to submit an offer of purchase. You can select tickets by moving them to the shopping cart without committing to a purchase yet. You will subsequently be asked to enter Your personal data and bank details.

By clicking the ‘Buy Now’ button (“Jetzt kaufen”), You are submitting a binding offer to conclude a contract. We will confirm Your order immediately via email (“Confirmation”). In doing so, we are accepting Your offer, and a contract between You and Us will come into effect. After processing the order and sending the Confirmation, We will store the text of the contract (the Confirmation and these GTC), but it will no longer be accessible to You online.

Unless otherwise agreed, payment of the ticket fees is due immediately upon concluding the contract. We accept advance payment via bank transfer or immediate payment via PayPal. When choosing advance payment via bank transfer, the Attendee transfers the total price of the tickets to the account of Choriner Musiksommer. Bank details will be disclosed to the Attendee on the invoice.

We reserve the right to exclude particular methods of payment or refer to other methods of payment in individual cases. The payment methods available will be displayed to the Attendee prior to booking.

5.3.5 Ticket sale at the box office

Remaining tickets can also be purchased at the box office at Kloster Chorin. The box office sells only remaining tickets for the Concert of the current day. Advance booking for other Concerts is not possible. The box office opens 1.5 hours prior to the beginning of the Concert.

5.4 Ticket sale to tour groups

Any group visiting a Concert in the course of a one-day or several days’ trip organised by a commercial provider counts as a tour group (“Tour Group”). Individuals who purchase 20 or more tickets per Concert also count as Tour Groups.

For Tour Groups of 20 or more persons, the following provisions apply:

Tickets are sold exclusively by email, fax or letter.

Terms of payment differ as follows:

Unless otherwise agreed with Choriner Musiksommer, the commercial provider or individual doing the booking shall make a deposit of 1/3 of the invoice total to the bank account stated on the invoice within a period of fourteen (14) days.

5.5 Ticket shipping

Tickets are shipped by mail on receipt of payment. A flat-rate shipping fee (“Shipping Fee”) of €3.50 will be charged once for every order. Depending on the carrier, Deutsche Post, the period of delivery within Germany will be one (1) to three (3) days. Tickets booked in advance cannot be collected at the box office.

6. Redeeming coupons issued under the COVID-19 Pandemic Mitigation Act

When purchasing tickets, You can redeem coupons that We have issued for concerts cancelled in 2020 under the COVID-19 Pandemic Mitigation Act (Gesetz zur Abmilderung der Folgen der COVID-19-Pandemie im Veranstaltungsvertragsrecht), hereinafter referred to as “Covid 19 Coupons”. Redemption of Covid 19 Coupons is only possible at Choriner Musiksommer and only by phone (section 5.3.1 of these GTC) or by email, fax or letter (section 5.3.2 of these GTC). The following special conditions apply:

6.1. Eligible persons

Covid 19 Coupons are personalised and can be redeemed only by the person who is stated on the coupon as owner. Covid 19 Coupons bear the following information: a unique coupon number, the date of issue, the value of the coupon, the customer ID and name of the owner, a unique barcode, a unique barcode number and the period of validity. If You are not the owner specified on the Covid 19 Coupon, you can redeem the Coupon only if the rightful owner has transferred the rights bestowed by the Covid 19 Coupon to You and if You can present a written statement by the owner to prove the transfer.

6.2. Redemption of Covid 19 Coupons

To redeem a Covid 19 Coupon via phone, you must state the coupon number when ordering. To redeem via letter or email, send the Covid 19 Coupons by mail to the address stated in section 5.3.2 or communicate the coupon number in Your email.

6.3. Conclusion of contract, crediting

You will be credited the value of Covid 19 Coupons when purchasing tickets as follows:

6.3.1 Ticket price equals coupon value

If the total price of tickets ordered is equal to the value of the Covid 19 Coupon or Coupons, We will send You an invoice stating the ticket price and the value of Covid 19 Coupons credited to You along with the tickets. Tickets will be shipped within 3 workdays after You place Your order. The contract between You and Us will come into effect as follows:

When ordering via phone, the contract comes into effect in the course of telephoning. Your phone call represents an offer on Your part to conclude a contract on purchasing tickets, which will come into effect on acceptance of Your offer by one of Our associates.

When ordering via email, fax or letter, Your written order represents a binding offer to conclude a contract. We are accepting this offer by shipping the tickets and the invoice to You. The contract comes into effect on arrival of the tickets at Your address.

6.3.2 Ticket price exceeds coupon value

If the total price of tickets ordered exceeds the value of the Covid 19 Coupon or Coupons, You are obliged to pay the difference. We will send You a binding offer accompanied by an invoice stating the total of Your order, the value of the Covid 19 Coupons redeemed, the difference to be paid and a payment term of fourteen (14) days. Your payment within this period indicates that You are accepting this offer. If the difference payment is not credited to Our bank account within the term of payment, We will reoffer the tickets for sale. Tickets will be shipped within 3 workdays after receipt of payment.

6.3.3 Ticket price lower than coupon value

If the total price of tickets ordered is less than the value of the Covid 19 Coupon or Coupons, We will issue a new Covid 19 Coupon on the difference value. When sending the tickets to You, We will include an invoice stating the ticket price, the value redeemed by Covid 19 Coupons and the difference, for which We will have issued a new Covid 19 Coupon.

Tickets will be shipped within 3 workdays after receipt of Your order. The contract between You and Us will come into effect as follows:

When ordering via phone, the contract comes into effect in the course of telephoning. Your phone call represents an offer on Your part to conclude a contract on purchasing tickets, which will come into effect on acceptance of Your offer by one of Our associates.

When ordering via email, fax or letter, Your written order represents a binding offer to conclude a contract. We are accepting this offer by shipping the tickets and the invoice to You. The contract comes into effect on arrival of the tickets at Your address.

Upon redemption, Covid 19 Coupons become invalid and can no longer be used to purchase more tickets, nor can You any longer receive a payout of their value under the COVID-19 Pandemic Mitigation Act. You will receive a separate certificate of redemption for Your Covid 19 Coupons.

7. Legal warranty

Statutory warranty law applies.

8. Right of withdrawal

Under section 312g (2) number 9 of the German Civil Code (BGB), the purchase of Concert tickets, even when done online, by phone, email, fax or letter, does not establish a right of withdrawal. Subject matter of the contract concluded between You and Us is the provision of services related to leisure activities which are rendered at a specific date of performance. To such services, the statutory right of withdrawal on off-premises contracts and distance contracts does not apply. Consequently, Your order becomes binding on receipt of Our confirmation.

9. Resale of tickets

Tickets may not be offered for commercial resale without Our prior consent. Choriner Musiksommer reserves the right to exclude any person who is responsible for such activities from future purchase of tickets.

10. Discounts

Tickets at reduced prices can only be purchased via email, fax or letter (section 5.3.1 of this GTC) or at the box office. A discount of €3 on the regular ticket price will be granted to severely handicapped persons who submit a copy of their valid certificate when ordering or present a valid certificate at the box office; to their carers, if the person is entitled to be accompanied by them; and to students, apprentices and children if a copy of a valid certificate is submitted when ordering or presented at the box office. Different discounts cannot be combined.

11. Reservation

Tickets can be reserved from ten (10) days before a Concert. Reserved tickets must be collected and paid in cash at the box office at least thirty (30) minutes prior to the beginning of the Concert.

12. Return and exchange

12.1. No return of tickets

Attendees cannot claim a right to return tickets and receive refund of the ticket price.

12.2 Exchange of tickets

If You have purchased tickets by email, fax or letter (section 5.3.1 of these GTC) or by phone (section 5.3.2 of these GTC) and if Your tickets are still valid, You may exchange them for tickets of a higher price category if such tickets are still available. You will be obliged to pay the price difference. Otherwise, tickets cannot be exchanged once You have purchased them.

12.3 Booking changes for Tour Groups

Tour Groups of 20 or more persons may change their bookings under the following conditions: If 1/3 of the invoice total has been paid to Our bank account on time (see section 5.4 of these GTC), the number of tickets can be changed free of charge up to six (6) weeks before the date of the Concert for which the tickets were booked. The total ticket price of the changed order less the deposit already made must be transferred to Choriner Musiksommer’s bank account within fourteen (14) days of the change. The commercial provider or individual doing the booking will receive a final invoice from Us stating the number of tickets, their price categories, the deposit made and the remaining amount to be paid.

12.4 Changes in the programme and artists appearing

Choriner Musiksommer reserves the right to make changes to their programme and the list of artists appearing for artistic or organisational reasons. We will inform You about such changes on Our website. Changes to the programme, the artists appearing or the venue do not entitle You to return or exchange Your tickets.

12.5 Lost tickets

Lost tickets will not be replaced by Us.

13. Access to the Concert area, rules of conduct

Choriner Musiksommer grants access to the Concert area at Kloster Chorin exclusively to those Attendees who present a valid ticket. The time of admission is stated on the tickets. Tickets will be cancelled on admission.

Attendees may use only designated entries and exits and must take the seats assigned to them on their tickets. Taking any other seat than stated on the ticket is not permitted. If an Attendee changes to a more expensive seat without permission, Choriner Musiksommer has the right to claim payment of the price difference from the Attendee, move them to the seat indicated on their ticket or expel them from the venue.

Attendees are obliged to obey the provisions valid at the time of the Concert and applicable to Concert audiences due to the regulations on containing the SARS-CoV-2 pandemic issued by the State of Brandenburg as published on the website of the Brandenburg State Government. Detailed information is available from Choriner Musiksommer’s hygiene protocol, which can be viewed at the venue at Kloster Chorin. The information will be continually adapted to changing conditions.

Escape routes must be kept clear at all times. Hallways, aisles and cloisters, stairways, exits and emergency exits must not be blocked with items of any kind. Emergency exits serve to evacuate the venue safely in case of an emergency and are not to be used as regular exits.

Smoking is strictly prohibited inside the Concert area. This also applies to electronic cigarettes. Smoking is only allowed at the marked spots outside the Concert area.

The use of open-flame lighting, such as candles in any kind of enclosure, pyrotechnical products etc. is prohibited.

Children up to the age of 6 (“Children”) may enter the Concert area only when accompanied by an adult. Romping and climbing walls or railings are prohibited inside the Concert area. Attendees who enter the venue accompanied by children must ensure that these rules are obeyed.

Attendees may not bring tables, pavilions, sunshades, tents or similar structures or other bulky items to the venue.

Attendees may not bring dogs, except for guide and assistance dogs, or other pets to the venue.

14. Domiciliary right

During Concerts, Choriner Musiksommer holds the domiciliary right. Attendees must follow the instructions given by Our personnel. Choriner Musiksommer reserves the right to deny Attendees access to a Concert, or expel Attendees from a Concert or the Concert area. This applies in particular, but not exclusively, to the following situations:

if an Attendee interferes with the artistic performance, molests other persons or has taken a seat without having a valid ticket for that seat;

if an Attendee molests other Attendees in the Concert area; 

if an Attendee disobeys the hygiene and safety measures imposed to contain the SARS-CoV-2 pandemic; or

if an Attendee severely or repeatedly disobeys these GTC.

15. Cancellation and termination of Concerts

If a Concert is cancelled or terminated early by Us, tickets for that Concert become invalid. This applies in particular, but not exclusively, if a Concert has to be cancelled due to an official order, to Choriner Musiksommer’s own safety regulations or to other reasons related to the SARS-CoV-2 pandemic. If a Concert is cancelled or terminated early, We will offer Attendees a replacement Concert if possible. In case we are unable to offer You a replacement Concert or You cannot or do not want to attend the replacement Concert, We will refund the price of Your tickets. If a Concert is terminated early, We will refund a proportional amount. Any further claims by Attendees are excluded, provided that Choriner Musiksommer is not liable for the cause that led to the cancellation or early termination of the Concert. Other statutory provisions that entitle Choriner Musiksommer to cancel or terminate events remain unaffected.

16. Photography, video and audio recording

During Choriner Musiksommer’s Concerts, photographic, video and TV recordings (“Recordings”) are made by Us or by third parties on a regular basis. Such Recordings are used for the following purposes:

to announce and advertise Choriner Musiksommer’s Concerts through any kind of media (print, digital, video, TV etc.), in particular on flyers and posters, in newspapers and periodicals, on Our website, social media channels and in Our newsletters;

for Choriner Musiksommer’s press and public relations activities, including the use of Recordings on Our website, social media channels and in Our newsletters;

for live broadcast of Concerts on TV, including the subsequent release of Recordings in the broadcasting organisations’ media libraries; and

for archiving in both analogue and digital formats.

Insofar as You are recognisable in such Recordings, Your purchase of a ticket implies that You agree with the use of Recordings for the aforementioned purposes, in particular with Our publishing and distributing such Recordings or having them published or distributed by third parties.

17. Pictures and audio recordings

Under copyright and privacy laws, Attendees are not allowed to take pictures or make audio recordings during the Concerts. Outside of events, pictures at the Kloster Chorin venue may be taken exclusively for private, non-commercial use.

18. Data privacy

When gathering, processing and using Your personal data, we comply with the regulations of statutory law on data privacy, in particular with the European General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (Bundesdatenschutzgesetz, BDSG).

19. Lost property

Items of any kind found at the venue at Kloster Chorin must be handed in to Our admission personnel to be kept at Choriner Musiksommer’s offices.

20. Liability

Choriner Musiksommer is subject to liability under statutory law in case of intention or gross negligence on Our part or on the part of Our legal representatives or persons whom We use to perform Our obligations. We are also liable in case of Our culpable violation of essential contractual duties, i.e. duties which are essential for proper implementation of the contract and on whose fulfilment the Attendee regularly relies and is entitled to rely. Except for intention or gross negligence on Our part, Our liability is limited to the foreseeable and typically occurring damage.

Our liability owing to culpable injury to life, body or health, to having given a guarantee of quality or to fraudulent concealment of a defect as well as Our liability under the Product Liability Act remain unaffected.

Unless otherwise expressly stipulated above, Choriner Musiksommer’s liability is excluded.

The above provisions apply accordingly to the liability of Our legal representatives or persons whom We use to perform Our obligations, if claims are asserted directly against them.

Any possible liability privileges in Our favour, such as privileges under sections 7 to 10 of the German Broadcast Media Act (Telemediengesetz), remain unaffected.

21. Online dispute resolution and consumer arbitration boards

The European Commission provides an Online Dispute Resolution Platform (“ODR Platform”), which You can use to settle disputes resulting from or related to online purchase contracts. Choriner Musiksommer is neither willing nor obliged to take part in dispute settlement involving consumer arbitration boards.

22. Applicable law, place of jurisdiction

The law of the Federal Republic of Germany shall apply, excluding the provisions of the UN Sales Convention (CISG). This choice of law applies only insofar as it does not deprive the Attendee of mandatory applicable consumer protection rights of the country where the Attendee has his or her habitual residence at the time of ordering.

If the Attendee is a merchant, a legal entity under public law or a special fund under public law based within the territory of the Federal Republic of Germany, the competent court at the domicile of Choriner Musiksommer shall handle all disputes resulting from the contract concluded between the Attendee and Choriner Musiksommer exclusively. If the Attendee’s domicile is outside of the territory of the Federal Republic of Germany, the competent court at the domicile of Choriner Musiksommer shall handle all disputes resulting from the contract if the contract or claims therefrom can be attributed to the Attendee’s commercial or independent business activities.
